Rather, it has developed as a layered structure composed of regulations issued by different authorities, which together form a coherent—albeit evolving—regulatory system.

At the core of this framework lies the Capital Markets Law No. 6362. Following recent amendments, crypto assets and crypto asset service providers have been defined at the statutory level, and entities operating in this field have been made subject to authorization by the Capital Markets Board of Türkiye. The law establishes the fundamental principles governing incorporation requirements, shareholding structures, capital adequacy, organizational obligations, technological infrastructure, and the safeguarding of client assets. In this respect, the crypto asset market has been positioned within the broader framework of capital markets regulation.

This statutory framework is further detailed through secondary legislation. The relevant communiqués governing the establishment and operation of crypto asset service providers require these entities not only to obtain a license, but also to maintain a defined corporate structure, implement internal control and risk management systems, and comply with specific technological and operational standards. The execution of platform activities, order handling, custody arrangements, and listing procedures are all subject to detailed regulatory rules. As a result, the crypto asset market in Türkiye has been aligned, in many respects, with the operational logic of traditional capital markets institutions.

At the same time, a separate regulatory approach has been adopted with respect to payment systems. Under the regulation issued by the Central Bank of the Republic of Türkiye, the use of crypto assets as a means of payment has been explicitly prohibited. This prohibition extends not only to direct use, but also to indirect models, including the involvement of payment institutions in transactions with crypto asset platforms. This approach reflects a deliberate policy choice: while crypto assets are not excluded from the financial system, they are clearly separated from the function of money and kept outside the payment infrastructure.

In addition, regulations implemented by the Financial Crimes Investigation Board (MASAK) have introduced a comprehensive compliance layer. Crypto asset service providers are classified as obliged entities and are therefore subject to customer identification, know-your-customer (KYC) requirements, transaction monitoring, and suspicious transaction reporting obligations. Through mechanisms such as the travel rule and remote identity verification, the possibility of conducting crypto transactions in an anonymous environment has been effectively eliminated. The market has thus been brought within a framework of traceability and regulatory oversight comparable to that of traditional financial systems.

When this framework is considered as a whole, it becomes clear that the crypto asset market in Türkiye is already subject to a substantial degree of regulation. The draft law submitted to the Turkish Grand National Assembly on 2 March 2026 (Bill No. 2/3560), which was later withdrawn, was intended to introduce a tax layer on top of this existing structure. The proposal envisaged the introduction of a transaction-based tax on crypto assets, the establishment of a framework for the taxation of income derived from crypto assets, and certain VAT exemptions for specific transactions.

That said, the proposed tax model appears to require further refinement in certain respects. In particular, the simultaneous consideration of both transaction-based taxation and income-based taxation may give rise to risks of overlapping or excessive taxation, as well as potential uncertainties in practice. It may also be noted that a more comprehensive assessment of the possible implications on international competitiveness and market dynamics would contribute to a more balanced regulatory approach.

When compared with the MiCA Regulation in the European Union, the Turkish framework appears more fragmented in structure. However, in terms of licensing, corporate governance, investor protection, and compliance obligations, a broadly similar regulatory rationale can be observed. A key point of divergence lies in the treatment of payments: while MiCA allows for the regulated use of certain crypto asset categories, Türkiye maintains a clear prohibition on the use of crypto assets as a means of payment.

In conclusion, the crypto asset market in Türkiye currently operates within a regulatory environment in which service providers are licensed under capital markets legislation, crypto assets are excluded from payment systems, and strict compliance obligations are imposed under anti-money laundering regulations. Going forward, the primary area of discussion is likely to focus on the scope and structure of the tax regime to be introduced on top of this existing framework.

REGULATION OF CRYPTO ASSETS IN TÜRKİYE In Türkiye, the legal framework governing crypto assets is not derived from a single piece of legislation.
